HMO License for a Freehold property divided into flats where the title is not split

I own a Freehold House, which has been physically split into 2 flats for a number of years.

The utilities and bills, including council tax have been split for many years.

I live in one flat, the other is a 3 bedroom flat, usually let out, that will now require a HMO license as the law has changed.

Can I still get a license from the council even though the freehold title of the house hasnt been split up into flats ? Or do i need to split the title into seperate flats before the HMO license is granted ?
