Has anyone had their licence rejected on the grounds that they are not the person having control of their properties?

We have received a letter from our management company stating 'we have had a number of applications rejected on the basis that the landlord is not the most appropriate person to hold the licence. Instead the council have advised that the managing agent is the most appropriate person to hold the licence and therefore applications must be held in their name. A number of landlords have made applications direct and received the same rejection and response' Also if rejected the initial application fee my be forfeit.

We have not heard anything from the council about our application.

I disagree with what they are saying looking at the Sections of the Relevant Act.

Thoughts please?
