I served a section 21 to my tenants that expired In February 2022. I followed this by filing for accelerated possession as the tenants did not honour the section 21 notice. Now last week I finally received an update from the court stating the following statement :
“Upon considering the claim and the defence pursuant to CPR r.55.16(1), court is not satisfied that :
The Claimant has established that he is entitled to recover possession against the Defendant under section 21 of the Housing act 1988.
AND
The claim is listed for a hearing on the first open date not less then 14 days in the possession list, time estimate 30 minutes. “
I have not received any defence that has been filed by the tenants .
Does this decision mean that the claim has been dismissed or there is still any chance that a final decision would be made on the hearing date?
