Date of which I can apply to the court for a hearing

I have a tenant who over 5 months behind with his rent and whose assured shorthold tenancy expires 28/08/2020. On the 13th of July I issued him with both a Section 8 and a 21 notice (using the amended Covid relevant forms), giving him the prescribed 3 months notice.

When the courts open on the 23rd August can I immediately apply for a court date (assuming there will be a long delay) or do I have to wait until the notice period has expired?
