We manage a property where the tenant owes over £3000. They are tenants with residents permits, however their permits exclude them from any benefits. All 3 adults, have apparently had zero income due to covid. They are still not back in work and have no way to make any further payment. We have served a section 21 notice, and next week intend to serve a section 8. I assume the court process will be even more lengthy than usual given the back long of hearings and new applications.

The landlord is willing to wipe clear the rent arrears if the tenants leave the property and surrender their deposit. I have tried to call and meet the tenants face to face to discuss this, but they are refusing to meet me and wish only to be contacted by email.

My worry is that if I put anything in writing and they do not leave the property that it will cause us problems if we do have to attend court.

What would you suggest I do? Can we make the offer over email or will it jeopardise any future court hearing or being able to claim money back? If we have to go to court, we will obviously claim all rent arrears, plus interest and any court costs. We want to get this resolved easily and amicably as the landlord is seriously out of pocket, he even had a brand new boiler fitted whilst not receiving rent. He is doing everything his side, but we are not getting anything in return from the tenants.
