Lost/Misplaced Tenancy Agreement
Possession - Section 8 and Section 21

I have a friend who has come to me with a problem, he previoulsy used a letting agent to manage his property, whose performance was lets say well below par. This resulted in him taking the property back to manage himself.

Apparently there is no trace of any tenancy agreement, neither him nor his tenant has one. The tenancy is now in arrears, and they have come to a mutual agreement that if she leaves the property then the debt will be reduced.

However the tenant needs a notice to show the council he wants the property back, the question he has asked is should it be a Section 8 or 21 Notice.

We (both him and myself) would be grateful for any advice. The tenant is keen to go but needs the correct documentation to show the council.
