Hi All,

Just wanted to bounce this one off you.

So in one of my student HMO's i have one tenant who has moved out after 2 months, they have not moved out because of covid-19, our leaving Uni - indeed they have moved into a house just down the road.

I have a parent as guarantor. I am clear that they are liable for the rent for the remaining term (till 30th june 21) as are they.

However they have now stopped discussions.

Technically the first rent missed was only the 1st November (so not an old debt)according to the terms of the contract i can charge interest on any outstanding rent after 7 days from due date.

Given ongoing discussion no longer seems an option i was planning to go down the CCJ route,

Question, how soon after a debt is due can one apply to MCC? given that i know the money issn just "arriving late" & secondly.....do i wait till the end of the term or can i issue earlier.....perhaps one every month if they wish to be awkward?

They have chosen not to try and source someone to take over the AST, i just wanted to be clear on the routes open to me before i find a replacement. Any one had any similar situation or can suggest any appropriate routes forward.
