I have a very difficult tenant in one of my HMOs. Because of his extreme anti social behaviour the Council put a partial closure order on his room in late October meaning he can't have any visitors in his room. This has reduced the ASB in the house but it only lasts 3 months. After 1 month I put in a Section 8 possession order using the Closure Order as a mandatory ground for eviction. The court has taken my money and I have a case number but it hasn't done anything that I know of. I've sent 3 emails asking what's going on and although they've received them I haven't had a response. The Closure Order expires at the end of January. If the court case happens after the closure order expires does that mean I don't have my mandatory ground for eviction? I'd have hoped it would be based on the timing of the application otherwise the tenant could just play the delaying game until the ground expires?
