Charnwood Borough Council [Loughborough] is adopting a selective additional licensing scheme for HMOs with 3 and 4 unrelated occupants.

There is currently an open consultation on the proposed licensing conditions, inviting comments [until 26/02/21]:

One of the proposed conditions seems nonsensical:

Proposed Condition 15 - References: states that the HMO licence holder will be required to take references as to character and behaviour in respect of every prospective tenant in advance of their being offered a tenancy and taking-up occupation at the HMO.

%E2%80%A2 Furthermore, the HMO licence holder will also be required to take action, should a tenant engage in acts of anti-social behaviour whether within the HMO or the immediate neighbourhood.

My question: is it lawful or even meaningful for Charnwood Borough Council to demand that the HMO licence holder takes references as to character and behaviour in respect of every prospective tenant?

The implication being that the HMO licence could be revoked on the basis of a breach of conditions if a prospective tenant was not able to provide references as to character and behaviour, and a tenancy was subsequently granted.
