Section 8, 21 overridden by new section 8 after 6 months arrears

Is anyone going through the process of issuing a new section 8 with 4 weeks notice now their tenant is 6 months in arrears? We're already issued a 6 months section 8 and 21. Our solicitor is suggesting not to do this as there is no prescient set in court yet but it's legally allowed under the new covid rules. Anyone had any experience? Has anyone managed to get to court yet? I don't want to ring solicitor and discus it as I'll be charged!!
