Hi, we are considering buying a rental property to help fund my mothers dementia care home costs. Now that there is a minefield of paperwork to go through to let a property all with fines attached if not completed correctly. If something went wrong and a fine was issued who would be liable for the cost, ie from my mother accounts (she has no mental capacity) or the acting Lasting Power of Attorney (LPA) from their own private personal accounts. This would be an important liability to consider before the family proceeds with a property purchase to avoid LPA's incurring personal costs, debts or worse by taking on a rental property. Would the rental agreement also have to be between my mother and the tenant or would it be between the LPA and the tenant? If the property is bought with my mother's money and is in her name?
