Can I apply for a CCJ to reclaim rent arrears from my tenant?

Hi NLRA team,

I have a tenant who has been in arrears since January 2020, so pre-pandemic.

I have previously agreed a repayment plan with said tenant but he has failed to adhere to the agreement and has continued to miss rent payments. As such, he is now in 6 months of rent arrears as at May 2021.

I have already contacted the tenant and his guarantor several times to request these rent arrears be brought up to date but communication has ceased from their side. I have tried to contact the tenant via phone call, text and letter with no response and have tried to contact the guarantor via letter with no response.

Can I apply for a CCJ to have the payment of the rent arrears enforced? Although the tenant is in 6 months of arrears, he has paid rent his rent for this month (May 2021) within the last couple of days and included a small payment towards the rent arrears. However, the outstanding arrears still equates to 6 months worth of rent.

Can I still go ahead with a CCJ application for the remainder of the outstanding debt? I am unclear whether any restrictions apply because of the ever changing rules in regards to the pandemic.
