Further to a possession order being granted we eagerly await the vacating of our property 31.5 with rent arrears outstanding into the 5 digits (high twenty thousands). During the possession hearing (further to a S21 being served) , the judge adjourned on monies being owed with disrepair issues raised by the tenant. The tenant filed their defence, early May with a counter defence submitted by our solicitors approximately one week ago. Should the judge not award a money judgement and having already heard from the legal team ( appointed by the LL Insurance) that with such a verdict, there would be `no prospects` , so would not cover a second attempt to recover the arrears....... What would the advice be of this (NRLA / contributors) experienced team for the various avenues to pursue ? as to the least risky, least onerous financially and highest chances to succeed if privately funded.
