Hi. We let out a 3 bedroom flat to 3 students belonging to different households which constituted an HMO. We applied for HMO and while the application was in process, council allowed us to rent out. This month the council approved our HMO application. This approval was sent out to head lease holders among others. They have found that under the terms of sub lease we are not allowed to rent out as an HMO. Apparently this was an oversight from our side. They have demanded that the application for HMO be withdrawn which we have. The tenancy expires in June 2021 without any break clause. My question is that due to this extra ordinary circumstance and the fact that it would be illegal to rent out as an HMO, can we serve a section 21 notice to the tenants?
