Hi

I have an order for possession is backdated to give possession end sept and pay court costs too. Rent is due on in 1st week of month and sept and Oct not paid. Tenant still in property says going to leave but not very cooperative and has said many things before and not kept to them. I have deposit for 1 month.

Q1 if I issue money claim against guarantor and tenant am I seeking court fee or enforcing the original court fee ordered against tenant? I’m confused as possession order is not a ccj and warrant to enforce doesn’t seem to enforce the costs part.

Q2 if I issue money claim am I saying claiming sept and Oct rent or damages equivalent to rent? Reason I ask this is because I don’t want to create a new tenancy by demanding rent but not sure if that matters. Not sure impact of possession order on rent payments.

Q3 if I issue warrant for bailiffs now can I include 130 fee now in money claim or should I demand it first and issue seperate money claim later.
