The courts remain closed until at least 23 August. Once they reopen, there is a risk they will be overwhelmed by the backlog of five months' of possession cases. The NRLA is sitting on a judicial working group looking at how the courts should reopen, and is pushing for there to be a prioritisation of cases, including where landlords had been granted possession prior to the coronavirus restrictions, incidences of antisocial behaviour, and serious rent arrears building before lockdown, as well maintaining the option to use Section 21.
