Our tenant is in arrears and we're suspicious that proper referencing might not have been carried out by our letting agent. We have requested copies of the references, but the agent has refused, quoting GDPR rules. However, another agent has told us that we have every right to see the references, which sounds correct to me?

Does the agent have an obligation to provide us with copies of the references, and do we have any recourse, regarding the arrears, if proper referenceing was not carried out?

Many thanks,

Nick.
