I own a Long Leasehold house on a secure development in East London - the house is let and I've obtained an HMO licence to cover this - now the Freeholders managing agent has written to me advising of a Breach of Lease - Fourth Schedule (Tenant's Covenant's), clause 9 - To use the house as a single private dwelling.

All tenants are on 1 single AST.

Houses have been let on the development for many years to groups of 'sharers' and the Freeholder has always known this and been responsible for granting & controlling access to the development and leisure facilities.

Does the granting of an HMO Licence create a breach of the Fourth Schedule ?
