Letting agent failed to protect deposit within 30 Days

Just after some advice, the agent managing our property went over the 30 days in protecting the deposit after receiving it.
Tenant has not raised the matter but his tenancy has ended but we wanted to claim on the deposit but having concerns since we realised when the deposit was protected. Should I be concerned if the tenant becomes aware of the deposit not protected within 30 days.
