I've advertised a property as no-smoking and I've provided a copy of the contract which clearly states no-smoking.
Tenants have now completed referencing successfully and while talking to them my gut instinct tells me one of them is a smoker or enjoys the odd smoke.

They haven't signed the contract yet, I've got more people waiting, but they will have wasted 2 weeks of my time if they are smokers. Can I legitimately decline the rental and keep the 1 week holding deposit?
If I cannot legitimately keep the deposit, can I keep the equivalent fees for the referencing.
