I've phoned and written to the tenant on more than one occasion asking for access for Gas Safe engineers to complete the gas safety check and separtely asking for an opportunity to completer a six monthly inspection to check on maintenance.

I've had no response to any of my letters.

Does a lack of response constitute refusal?

I know in terms of contract law, that "Acceptance must be communicated clearly and cannot be imposed or assumed due to silence". However I don't know if this would be considered a contractual matter. So does this principle still apply?

Having tried repeatedly to elicit a response, if I now serve written notice that we wish to enter for the purpose of gas safety checks at least 24 hours after the notice is delivered and we receive no response from the tenant, where do I stand?
