Fire at flat, tenant was at fault.

Hello,

I need some advice pls. New tenant on AST contract, (With guarantor) She collected keys And proceeded to move in her items. Within 20 mins her or helper either tried the hob and then placed a cardboard box on the hob and left to get more belongings. The flat above heard the fire alarm going off and then called fire brigade, they kicked the door in and put out the fire. The flat needs a complete refurb, £40k worth. I have buildings insurance. They do not insure the contents ie: white goods, carpets. They do not insure loss of rent either. Place has been empty since 4th July, builder starts in mid Oct, should be finished end Nov (5-6months no rent)

The tenant has threatened me with court action for her 1st months rent(baring in mind I received 50% due to agent fees) and she wants 100% of her deposit back. I have total losses amounting to £5900(loss of rent and contents)

The deposit scheme has stated the losses I am claiming for, should have been insured. I don�t think that�s correct. Surely I can claim off her deposit for damages? Can I go after the guarantor for the £5900?

I have a fire report which states the person residing at the property caused the fire accidentally. Any advice on this would be appreciated. Thanks Neil
