Our Letting Agent rented our property to a tenant who failed to pay rent, gave no deposit and caused a considerable amount of damage. The tenant left. The Letting agent then asked us to do some repairs, we did some of the things asked including damp work. We were not given pictures or video or move in move out reports which is in line with their terms. The Letting agent rented the flat to a new tenant on a 6 month AST the tenant moved out after 1 month, the Letting Agent allowed the person to vacate without asking our permission. We demanded move out report, to retain the deposit etc the Letting Agent ignored us and refunded the deposit despite our demands. The Letting agent stated they had a new tenant so we had no loss of rent. We continued to demand they pursue both tenants. The Third tenant then refused to move in due to damp etc etc. Damage was caused by Tenant 1 or 2, the Agent refused to provide a move in move out reports. The agent is taking over 1 month rent a new tenant fee, they did not charge us for Tenant #3 but they did for tenant # 2 then they Agent asked us to refund the first month rent to Tenant #3. Our stance is the Agent has acted without our permission, has refused to disclose information and it turns out the flat is not in a fit state to rent under health and safety reasons, we are now having to do a total refurb at a cost of over 2 years rental income. Can we take action against the Agent? And the rent paid by Tenant #2 - If the Agent "rented" a place that the tenant then refused to move into - which was not fit to rent - we feel the Agent should refund this month's rent to the tenant. We feel strongly now that a lot of games are being played by this Agent. Thanks for advice.
