Hello. I have an AST with my tenant of three years. She is moving out to a purchased property. She should have gone by now but her conveyance is delayed due to Covid. As she has not moved out on the date she should have, my estate agent has advised her to pay me my rent weekly. This is not what is stated in the AST. The AST states monthly in advance. So far this month I have received four random amounts (no two amounts the same) and all on different dates not even a week apart. Some payments are four days apart, some are 16 days apart etc. I have no idea which dates these payments refer to. I am fed up with trying to make calculations to try and determine what payment relates to which time frame... I have emailed my agent and told her that an NRLA advisor has told me that the payments should be paid monthly in advance as per the terms of the AST. If the agent will not agree with abiding by the terms stated in the AST and not refer it back to the tenant what rights do I have to insist that this happens..? Am I able to advise the agent and the tenant of any illegalities due to the fact they have broken the terms of the AST..?
