Hi All,

I was hoping you may be able to offer some suggestions on an issue I have. I have two tenants on an AST jointly and severally liable on a property I own. It is a father and step son who live there and the father messaged the agent in September to say the son had moved out to go and live with his mother due to a serious operation he had had and was moving in with his mother to convalesce. Whilst this has been substantiated I know that the son is back at work (I have a recording of a conversation that we had (myself and the son) where he is stating that he is back at work as of 23/11 – he lacks the cunning of his father). I also have a suspicion that he has never lived in the house and was only on the tenancy so his father had sufficient funds.

Anyway, the long and short of it is that the father has stated that he cannot afford the rent and is paying in dribs and drabs. Despite this, he continues to lie and say that the son is still on sick leave, even though I have proof that this isn’t the case. I also have the address he is living at.

I just had some follow up questions on this:

- Is there a way I can find out based on the address the son is living at who lives at that property and for how long they have lived there? I suspect that the son has never lived in my flat as I say and believe proving this would improve my chances.
- How should I proceed in the main (Section 8/MCol)? The son has sufficient funds to pay the rent or at least his share as he earns £44k per year but is being protected by his father. The father refuses to answer any of my emails even though I have threatened action and will only communicate with the letting agents. The letting agents aren’t much good so I have resigned myself to the fact that the only way to recover any money is to fight it out alone.
