I have had an AST with a estate agent whereby I receive guranteed rent on my property, and they let it out as required. The contract was initially for 1 year, and has been rolling for roughly 3 years. I have been trying to get the property back for the last year with excuses and delays on the agents part re court delays.

An Initial S21 was sent in Feb 23 by them, but it appears they have not actioned an accelerated possesion order, even though they kept mentioning they were waiting for court dates.

The long and short of it is they have sent me a copy of the 2nd Section 21 sent on 23rd November 2023, which with two months takes the date to 23rd Jan.

I have decided to take matters into my own hands with regards to the possesion order as I have lost faith, but was not sure if I can action this under my name if the Section 21 was from the estate agent (Landlords agent).

Another oddity is the tenant didnt pay a deposit, but this was provided by the council and the agent has confirmed that this protected by DPS. Assuming as long as we have the evidence of this it should be fine.

I am using the guidelines provided on the NRLA website re the possesion order but it would also be helpful if anyone can recommend a speciallist like Landlord action that could help or be utilised as this is the first time I am going through this. Location is HA6.

Thanks
