Minimising A Tenant's Losses

Hi, I have a tenant who has rented a house sine May '08. She was employed and consistently paid her rent until she was made redundant at the back end of Nov. She is now six weeks in arrears.

Her mother is guarantor and in a good job. Her mother is not abiding by her guarantor agreement, ie not paying the rent. The mother wants me to evict the tenant so that the tenant will be made homeless and therefore gains extra points to get a council flat. The tenant will not voluntarily leave the property. There are no children so ahe will get about £49 LHA single room allowance.

My thoughts are to let the situation ride, put debt collectors (Haymarket are, incidently excellent) and eventually sue the mother and tenant on the grounds we don't make people intentionally homeless. However I do know I have a duty of care to minimise a tenant's losses, ie should serve notice. However if on serving notice, she sits there it could cost me over £1,000 if I proceed to eviction.

What would your advice be?
