My tenant missed her rent payment in May 2010 and we met to discuss the problem. The tenant stated that an unexpected direct debit had been taken but there was no issue and could the missing rent be paid part next month and part the month after. I agreed on the provision that the rent was paid on time and the full amount paid up within 2 months. I also explained that in order to alleviate the problems with rent and transfer the tenant can sign the landlord benefit form to agree benefit payment for rent is paid direct to me and passed on a copy of the form.

The rent has not arrived again this month and the tenant is promising that it will be paid by the 15th. I have asked that form be signed to ensure the problems don't continue. The tenant agreed and since has not been in when they suggest i come and collect the form. The AST agreement finished in April.

If the tenant pays the rent for this month but not the arrears can I issue a section 21 notice for for the missing May rent? Should i wait and see if the landlord benefit form is signed? If it is can I still evict the tenant if the arrears are not paid?
