Tenant deposit and serving S21

I have acquired a property which has been  tenanted since 2016. The AST is rolling and the landlord noted that he would hold the deposit. I'm assuming he had an insurance scheme. I am unable to trace any info whether he did indeed do this. The tenants and previous landlord are not co-operating. I wish to seek possession of the property. Can I give the tenants the deposit from my own funds and serve S21? I don't have any paperwork other than a copy of the AST, can I assume the tenants were given the Gas safety/how to rent guide etc?
