Our tenant is now more than 4 months in arrears and we wish to evict her with as little damage to ourselves as possible.

Though we commenced the AST just after April 07 we were new to the business and at that stage were unaware (no excuse, I know) of the need for deposit protection. Shortly after that we did become aware and we returned the tenant's deposit to her, so we have no deposit.

Does the initial failure render a Section 21 inadmissible?
