I am going to Court after a Section 8 terminates for rent arrears, damages and possession. If a judgement is given for the money and the tenant has no possessions (having sold them already) can the court ask for this to be taken from his benefits? This tenant is deliberately making me take him to court, even though he is not living in the property, so that it will cost me more money and I believe he thinks he won't have to pay anything. He will not contest the court action.
