Section 21 Notice
Possession - Section 8 and Section 21

We had served a tenant Section 21 (1)(B) notice to a tenant the notice expired on 25/12/09.

We submitted a claim under N5B on 06/01/11 and the court has sent back the claim stating the District Judge has made the following comments

"No, the notice is over 12 months old".

My understanding is that the section 21 notice has no time limit as long as no new tenancy is issued.

Please advise if there is a time limit for the section 21 notice.
