Advice on treatment of partial payment for rent or deposit

We are looking to issue a section 8 and 21 on a tenant who has not paid their deposit or any rent but has made a small partial payment.

We do not know whether to treat this payment as contribution towards the deposit and submit to DPS or to treat this as a partial payment towards the rent.

The deposit is £325, the rent is £325/month from June 1st but all he has sent is £94.10 on the 20th July.

We were concerned that section 21 requires the deposit to be lodged appropriately but we do not know how to treat this one-off payment.

Should we treat it as contribution towards the deposit and lodge it with DPS or should we take the position no deposit was paid but this was a late partial rent payment.
