Section 8 notice

Hi, I have a tenant who owe's 3 months rent which I am going to serve a section 8 notice on.
On the notice in ground 10 (b) it say's except where subsection (1)(b) of section 8 of this act appllies, was in arrears at the date of service of the notice under that section relating to those proceadings
I have looked up the act but cannot make head nor tail of it.
I have looked at the RLA site but could not find any detailed help in completing the notice as to if this sould be included or not.
What does except subsection 8 of this act mean?
Do I include it or not?
