Possession - Section 8 and Section 21

I have to evict a tenant but have not given her the precribed info when I took deposit in 2010 (i was not informed properly).
Should I serve section 8 rather than setion 21 ?
Will the tenant be able to claim its deposit and more even if she is 3 months behind on the rent ?
