Possession - Section 8 and Section 21

Issue a section 21, it's a mandatory possession procedure and they cannot file a defense (although, unbelievably some judges will allow them one!. Whichever way that goes, you WILL be granted possession.

From what you say, S8 could be defended by them on the grounds of "repairs" even though you have mandatory possession rights under notice 8, it could get messy, best to bit the bullet, go S21 and then claim arrears once you have possession of your property.

Sorry to hear you've had such a bad deal of it but good luck with the possession.
