Yes I understand Dave however its not about getting away with it. If the tenant pays it into our bank account because that what he wants to do, how can I stop him? Its not about structuring it this way. If I then secure it as a deposit how do I then get access to it to pay the monthly rent? Its not about taking it as a deposit its about paying the rent. And its not the same as your old AST as we are not continuing to take payments despite the additional advance rent payment.
