I have a tenant who has fallen behind with her rent, although she is now paying regularly. She suggested that I reclaim her deposit against part of the the rent arrears, even though her tenancy is ongoing. She says she will be prepared to agree to the deposit being returned to me. Can we do this without having to end her current periodic tenancy and signing a new agreement?
