Must the letting agent hold the deposit, or can the landlord?

So it all depends what's in the Agency Agreement, and not specifically governed by the same law that covers the Tenancy Deposit Schemes?

That would mean that I might not be able to do much about the previous agreement and its deposit, if it is stated clearly in there, but I can certainly make sure that I have it covered in future agreements.
