Hi,
I am in dispute with a tenant regarding their deposit. I have given most of it back to the tenant and the final amount is for cleaning which he is disputing.
I have had to lodge the cleaning amount with My Deposits and have decided not to go with their ADR service and would rather the tenant took me to court so I can stand and give my own evidence rather than relying on the ADR which is more for the tenant. I have spoken to My Deposits and asked if the tenant does not take me to court and decides to do nothing and the money just sits with My Deposits am I allowed after a certain amount of time to claim it back. They said no. Is this correct?
