I have a tenant who left owing over £3000 rent, plus the apartment is a real mess - it will need new carpets, a complete re-dec, professional oven clean etc etc: I have no forwarding address for this tenant. He paid £650 deposit which my agent refuses to release (held in her nominated scheme) for these works - she insists the tenant needs to contact her to agree that I use this money in the above manner.
What is my position?
