Can anyone advise...

If a landlord has paid deposit into a scheme but has failed to notify the tenants of this and there is a dispute over the deposit at the end of the tenancy then is the tenant still able to take legal proceedings against landlord and are they still liable to pay the penalty of 3 times the deposit?
