Agent has spent tenants deposits and cannot repay

My problem is that my agent, whom I have now fired took deposits from my tenants, secured them with certificates of deposit, but then spent the money. She cannot now refund the tenants at the end of their contracts.
Can my tenants claim from Tenancy Deposit Solutions as they are presently out of pocket or will TDS regard me as responsible and refuse to step in?
