We took a holding deposit from a prospective tenant who needed to give two months notice. We withdrew the property from the market subject to the deposit of one weeks rent £400. Having received the RLA tenant referencing and the prospective tenant has been declined because of a CCJ of over £6000. We are likely to withdraw the offer to rent. Do we need to return the deposit. We have lost at least one month's rental.
