I recently used a letting agent on a 'find me a tenant only' basis. Agent took deposit from tenant but agent didn't notify me in time for me to register the deposit and issue prescribed info within 2 weeks. Agent is ARLA registerd, they say its not a problem as the money is held in their bonded scheme and when I give them the TDS reference they will forward deposit to TDS scheme. I'm not so sure this is correct and think it would be best if agent refunds the deposit to tenant and tenant then gives the deposit direct to me. I can then get it registered within the 2 week deadline. Any views?
