Old agent not transferring deposit

Hi
I've got an issue with the agent who took the deposit off a tenant at the start of tenancy, although also did not give a tenancy agreement either. We took over as the Agent as the landlord wasn't getting any rent from the previous agent and they have since taken legal advice regarding that. The tenant who we now have asked who held his deposit, we have our own DPS account and have requested for the deposit to be transferred into this but are not getting anywhere, any advice or legal stance would be appreciated.
