One of the agents I'm using in the North East refuses to answer my questions regarding which tenancy deposit scheme he's using. If, as I suspect, he's not actually using one of the approved schemes, does this leave me exposed to the penalty that tenants can claim if they don't get their deposit info on time?

My suspicion stems from difficulties getting the deposit from a previous delinquent tenant released to me (as in I suspect either the agent has had it from the scheme but not sent it on to me, or more likely it was never in a scheme and he's spent it).
