I am currently completing paperwork to evict a tenant from my property whose ASTA has expired.

I have noticed in the Court notes that "from 6 April 2007, the claimant cannot use the procedure if a deposit that has been taken for the tenancy has not been protected under sections 212 to 213 of the Housing Act".

The tenancy started in 2006 and I have personally held the deposit since then. I understood that it was only new tenancies that would be affected by this. Am I okay to continue with proceedings?
