As we are not members of a Tenancy Deposit Scheme, we used the following wording for the additional months rent paid by the tenant upon taking up occupation as well as their month's rent in advance:-

`The Landlord is currently holding one months rent of £1,400 which shall be returned at the end of the tenancy, subject to there being no breaches of the terms of this agreement.`

The tenant is now over two months in arrears (2 months at £1,400 + previous arrears of £723). total £3,523.

We wish to serve a Section 8 Notice and would like to know if this is in order at this stage?
