My let only agent took two month's rent in advance (from a recent tenant he provided for me), rather than one month plus a deposit. I didn't register any money with a protection scheme. The agent later learnt that he was wrong in assuming the additional month's rent didn't count as a deposit. That tenancy has now terminated, the tenant receiving a full refund with the additional month's money paying for his last month of tenancy.

Given that he got a full refund and that his tenancy has now terminated, can the tenant still take me to court regarding non-registration of deposit?

Any thoughts would be welcome.
